2. LEARNING OUTCOMES

Learning Outcomes

The aim of the present course, following the course ENVIRONMENTAL LAW I of 3rd semester, is to provide students with the basic understanding, on the one hand of the historical evolution of the sustainable development legal texts and on the other hand of the principles, tools, institutions and procedures of domestic environmental law, using case-studies and focusing on implementation issues in order to familiarize students with this particular branch of law. Specific attention is given to the interdisciplinary character of environmental law as well as its dependence on technology. Additionally, the aim of the course ENVIRONMENTAL LAW II – INTRODUCTION TO PUBLIC WORKS LAW is to provide students with the basic understanding, principles and procedures of awarding public works execution.

Upon successful completion of this course students will be able to:

  • Mention domestic environmental legislation (article 24 of the Hellenic Constitution and ordinary legislation and in particular the Act 1650/1986 regarding environmental protection) as well as the relevant environmental case-law.
  • Understand the administrative organization of environmental protection in Greeceas well as the concept,on the one hand of administrative and environmental licensing procedure, and on the other hand of environmental and strategic environmental assessment (procedures, stages).
  • Evaluate legislation and case law as regards Environmental Impact Assessment and Environmental Impact Studies.
  • Correlate Sustainable Development with international, EU and domestic environmental legislation and jurisprudence in the case of Renewable Energy Sources (RES).
  • Identify the basic concepts, principles and procedures of Public Works Award law.
  • Review environmentaland public works’ legislation and case law, using a legal database.
  • Acquire a critical knowledge of novel institutional key issues for Chemical and Environmental Engineers with emphasis on basic International, EU and domesticlegal texts, (international conventions, EU regulations&directives, acts, presidential decrees, ministerial decisions, Court judgments, etc.)

3. COURSE SYLLABUS

  1. Introduction and connection to the 3rd semester compulsory course entitled "Environmental Law I". The sustainable development (historical evolution - sustainable development in international and EU legal documents).
  2. Environmental protection in domestic law. Sources of the Hellenic Environmental Law. Constitutional protection of the environment (Article 24 of the Hellenic Constitution 1975/1986/2011/2008/2019). Constitutional protection of natural and cultural environment (Article 24 par. 1 and 6 of the Constitution).
  3. The sustainable development in Hellenic Constitution and case-law.
  4. The content and characteristics of the right to the environment. The environmental trial. Locus standi in environmental litigation. Representative environmental cases.
  5. The protection of the environment in domestic ordinary legislation. The Act 1650/1986 as in force. Structure and topics of Act 1650/1986. Protected areas system.
  6. The current system of spatial planning in Greece (Special and Regional Spatial Frameworks. Case studies).
  7. The Administrative Organization of Environmental Protection in Greece.
  8. Administrative and environmental licensing procedure. The environmental impact assessment process. EU directives and national implementation legislation. Environmental Impact Assessment and Strategic Environmental Assessment. Principles, mechanisms and tools.
  9. Content and stages of environmental licensing procedure. Representative case studies.
  10. The case study of “Renewable Energy Sources (R.E.S.)”: interaction of International, EU and domestic legislation and case law .
  11. Introduction to Public Works legislation. Procedures regarding the award and execution of Public Works. Legislative framework for the public procurement. Harmonization of Greek legislation to the EU directives. The Act 4412/2016 and recent amendments.
  12. Award criteria. Execution of Public Works. Public Works dispute resolution procedures.
  13. Finding legislation and case law as regards environmental protection on the one hand and public works  on the other hand, using a specialized legal database.
